Any act done against the law and against the people is a crime and is punishable under section 40 of IPC. In other words, an act harmful to public welfare which is prohibited by law is a crime. This human conduct is rejected by the society and law and is prohibited by law, and punishment is provided. According to famous jurists Bentham “Crime is that which the legislature has prohibited for bad reasons.” Austin “If a mistake is done at the discretion of the injured party and his representatives then it is civil damage; if a mistake is done by the sovereign or his subordinates then it is a crime.” Paul W. Tappan “An intentional act or omission in violation of law, without any justification and accepted by law as a felony or misdemeanor.” Blackstone has defined crime as “an act done in violation of any public law, which is prohibited.” Crime is also defined as “violation of public rights and duties in the original form”. Stephen, editor of Blackstone, “Crime is a breach of law, such breach being regarded with reference to evil tendency.” Stephen “Crime is an act which is forbidden by law and repugnant to the moral feelings of society.” Kenny “Crimes are wrongful acts, the sanction of which is punishable and in no way excusable; But if it is pardonable by law, it is pardonable only by the monarchy.” (Here, the word ‘sanction’ means punishment, and the word ‘pardonable’ means pardon by the monarchy.) Keaton “Crime is any undesirable act which the state considers correctable by initiating proceedings for the imposition of punishment, instead of leaving the remedy to the discretion of the victim.” Miller Crime is “the doing or non-doing of any act which the law prohibits or commands under the threat of punishment by the state by taking action in its own name.” Patton “The general characteristics of a crime are that the state has the power to control the procedure, to pardon or to punish.” In conclusion, there is no fixed definition of crime. Every scholar has defined crime according to his views. And all attempts to define it have failed due to the difference in the subject matter. Terence “Crime is not absolute like sin, which cannot be defined and whose existence is beyond the limits of what man can say and do. This is essentially a relative definition of behaviour which is constantly changing.” Overall act punishable against the law is a crime.
